A French company belonging to a large-scale distribution group requests our intervention to obtain the judicial resolution of a supply contract with a Spanish company. The Spanish company does not oppose the contractual termination requested insofar as it also requests, by counterclaim, the termination of the contract, however, it is disputed whether our client is entitled to recover the amounts claimed. Specifically, the adverse party asks the Court to assess whether our client has breached the contract, as the adverse party intends to imply, and, if so, whether the breach attributed to it is likely to exempt the Spanish company from its obligation to return the amounts advanced for undelivered products. Finally, our team of lawyers, working intensively with the legal department of the French group, achieved the full upholding of the claim filed, obtaining the resolution and the requested order to pay plus interest.
