The French agri-food multinational has reached an agreement with a Spanish company to set up and operate a container manufacturing centre dedicated exclusively to the supply of containers for the French company. Our firm has extensive experience at the contractual level and has drafted the tailor-made supply contract (bilingual, French, Spanish), defining the respective obligations of each party at the production site, as well as the conditions of supply of the products manufactured in said site. Given the importance of the French group and the production volumes, the principles by which the relationship has been governed and thus reflected in the contract are basically the following: 1 . Priority processing of our customer's orders 2 . Exclusivity of buildings and machines intended for production 3 . Conducting an annual and comprehensive risk audit of all activities 4 . Investments made at the expense and risk of the supplier of containers 5 . Evaluation committee to implement product optimisation plans 6 . Clausula Hardship 7 . Confidentiality The supply activity is a complex activity. The participation of a third party in an essential process of the activity of a product and the necessary optimisation of services necessarily entail close collaboration between supplier and supplier. The packaging supplier, to a certain extent, is integrated and involved in the activity of the user entity, it constitutes an essential link in the product's life chain. All these aspects, and many others, must be taken into account when concluding a supply contract.
